Amey/Colas Joint Venture TUPE transfer of High Output OTM Operations and Maintenance

TSSA recently attended a consultation meeting with representatives of the employees. This meeting took place with joint representation from Amey, Colas Rail and Network Rail.


A number of assurances were sought from Network Rail regarding the transfer that will possibly take place 1 April 2015. Set out below are the responses from the employer to various issues raised:

1) Employees will retain their existing terms and conditions.

2) Collective bargaining representation will be retained by the trade unions on behalf of employees and Network Rail will discuss with the trade unions which business of the Network Rail bargaining procedures this group will transfer into.

3) Network Rail will adopt their procedures in place of the Amey and Colas procedures for those transferring.

4) All employees will be able to join the Network Rail standard pension arrangements with the RPS.

5) Those currently in the Colas Rail Defined Contribution and Amey Defined Contribution Schemes will be allowed to join one of the Network Rail Railway Pension Schemes.

6) There are no proposals to change the current structure or numbers of employees.

7) BR protected employees transferring will retain their travel facilities.

8) Network Rail has different weekly pay cycles to Amey and also Network Rail do not pay employees on a monthly basis. Network Rail will inform us at the next meeting how they propose to support employees through this transition.

9) New PPE, mobile phones, lap tops and vehicles will be provided to use on the first day of the transfer. Where currently a van is provided, this will continue. Company policy is that vans can be taken home but must only be used for company business.

10) Where an employee has a current loan from their existing employer it is proposed that the outstanding loans are recovered and spread over the next three to four months, before the transfer.

11) Management staff at Doncaster and Swindon locations should remain there.

12) The Annual Leave period will have to change from March/April for the Amey employees to January/December and we will agree a formula to see that transfer through.

13) There will also be a change of pay anniversary dates to the 1St January. A transition agreement will be made with the Trade Unions.

14) The transfer has been safety validated.

Representatives from Network Rail will and have been meeting transferring employees.
