Balfour Beatty Rail: TUPE transfer of Rail Grinders to Colas Rail – Further meeting 30 June 2015

A further meeting has taken place with Balfour Beatty and Colas Rail at which clarification was sought on several outstanding issues.

Some of the issues below are updates from our last circular dated 22 June as well as some additional questions relating to the forthcoming transfer on 25th July 2015.

· Under the TUPE Regulations requirement to inform and consult the TSSA requested a full list of all the envisaged changes relating to all aspects of employment to be provided. This will be set out in individual letters to all transferring employees as well as the TSSA in the next few days. This information is a requirement of the TUPE regulations and should contain a comprehensive outline of all changes that will be taking place in relation to the transfer.

· Colas rail are still to meet all transferring employees individually and hope to have carried these meeting out within the next two weeks.

· TSSA have further requested a full list of all of those staff transferring, which is promised in the next week once discussions have been concluded with all staff affected (those remaining are office based only)

· It was promised that all members of the Balfour Beatty share schemes will be written to explain their options, all sums paid into the scheme will receive what they have paid including (if applicable to the particular scheme) a prorated bonus up to the date of transfer to Colas Rail.

· Colas have agreed that for those who deem the travel to Rugby to be unreasonable, to have a four week trial period immediately post transfer to assess the impact on the change before discussing their options going forward.

· It was clarified that TSSA sole recognition for collective bargaining on pay and terms and conditions for the Rail Grinders would continue post transfer, there would need to be discussion with the existing Colas Rail Company Council as to how the group fits in with the present Colas Company Council to which TSSA has several representatives. However as the grade will be transferring across as a separate group, sole recognition with the TSSA will be retained.

· Colas Rail advised of further employee benefits which will be made available to transferring employees via Health Shield, this will be communicated to all staff prior to transfer.

· The TSSA also requested that any non-contractual policies and procedures are communicated to all transferring staff, Colas informed us that all staff will undertake an induction and that this information will be communicated as soon as possible.

The next and most likely final consultation meeting will take place on 15th July; we will keep you updated of developments.
