Colas Rail Docklands Light Railway TUPE transfer Keolis/Amey Docklands

There has been a further meeting with Colas Rail and KAD where TSSA thought clarification on outstanding issues – set out below are the responses:

 

 

· Employees in the Railway Pension Scheme that are protected or have an indefeasible right will be allowed to join the Amey Section of the RPS. However it has come to light that there are three other members of the Railway Pension Scheme involved in this transfer who are not protected nor have an indefeasible right. KAD will respond on whether these three employees will be able to join the Amey Railway Pension Scheme after the transfer.

· In regard to the paying of employees, please see the following:

For those transferring for monthly pay to four weekly pay, the following will apply.

On 28 Nov Paid up to 31 Nov

On 17 Dec Paid from 7-19 Dec

On 24 Dec Paid up to 6 Dec

On 14Jan Paid from 20 Dec-16 Jan

As a result of an individual expecting to be paid a month’s money on the 24 December but in fact will have received only 19 days’ pay by the 17th December it has been agreed to grant a two week bridging loan from KAD to be paid by back by three months, if requested.

For those transferring currently on four weekly pay but will move to a new four weekly pay cycle, the following will apply.

On 2 Jan Paid up to 6 Dec

On 14 Jan Paid from 20 Dec-16 Jan

As a result of an individual having a change to their four week cycle by two weeks it has been agreed to grant a two week bridging loan from KAD to be paid by back by three months, if requested.

· The new vehicles have been ordered and will be available in time.

· A final decision has not been made in regard to where the transferring employees will be located within the depot at Poplar, and the logistics of a move within the depot if that is required.

· KAD will not recognise the Colas Rail Discipline and Grievance procedures as contractual and as result they should transfer with the employee, the TSSA does not accept that and expects them to transfer with the employee. KAD are refusing to do this and will adopt the Amey Discipline and Grievance procedure.

The TSSA will inform you of further information received as a result of this transfer consultation.
