Colas Rail Docklands Light Railway TUPE transfer Keolis/Amey Docklands

There has been a further meeting with Colas Rail and KAD but there still remains two outstanding issues requiring clarification.


TSSA also used the opportunity to put further questions to the incoming employer – set out below are the responses:

· The transfers will still take place at 03.00 on 7th December 2014.

· Employees in the Railway Pension Scheme that are protected or have an indefeasible right will be allowed to join the Amey Section of the RPS.

· KAD’s view on taking vans home is that if it is for work purposes then it is still acceptable. KAD will replace the existing six vehicles. PPE will be replaced but at first there may be a need to retain Colas PPE and eventually there will be a corporate TfL PPE. Telephone numbers should remain the same. New PCs have been ordered by KAD.

· There are no current plans to change patterns. If there were any changes these would be negotiated through the appropriate procedure.

· On day one the transferring organisation will come under Projects Team in Engineering at KAD.

· One position which will transfer to MJ Quinn will require a separate consultation.

· The organisation is going through DLR Assurance Plan for safety purposes.

There are two remaining issues:

(i) KAD have not clarified how they are going to deal with the two issues on

Pay, the transfer from monthly to four-weekly and the different four- weekly cycle to those currently on four-weekly pay.

(ii) Whether the Colas Rail Disciplinary and Grievance procedures transfer with the employees.
