Freightliner Intermodal All Grades Pay Update Sept 2014

This is an update on the position of negotiations with both the Freightliner Intermodal Clerical Grades and separate Management Grades pay claims for 2014.

Management Grades - Agreed

The company offer for a one year 3% increase in salary from 1st July 2014 until 30 June 2015 has been out to a referendum of members which has now closed.

The result of the referendum is as follows:

As a result of the majority of our members voting to accept this offer we have written to the company today formally accepting this on behalf of our Management Grades Members.

Clerical Grades – Ballot for Industrial Action

As communicated directly via email to Clerical Grade members last week, the company have made a pay offer in terms of settling the developing situation in relation to Holiday Pay calculations which is currently subject to a number of Employment Tribunal Claims.

These claims are challenging the average working pay which should be paid whilst an employee is on annual leave which (as the Tribunals have currently found) should include an average payment taking account of all allowances and overtime payments intrinsic to the work they carry out.

Whilst the TSSA have agreed to discuss the Holiday Pay matter separately from the Annual Pay Award (committing to a full day in September to do so) the company have decided to offer a settlement to this issue as part of the pay negotiations to “protect financial exposure to the business”.

Unfortunately their offer contains the caveat that this will be in lieu of a pay award for 2014 (i.e. a pay freeze for Clerical Grades) whilst they have committed with this offer to a second year deal of 3.5% for the period commencing 1st April 2015 to 31st March 2016.

Your TSSA Representatives do not find this acceptable and have therefore rejected the company’s offer on the basis that it does not benefit all our members within the bargaining group and compromises the pay negotiations where we have requested that both matters are discussed separately.

We have asked the company to reconsider this offer and apply a cost of living increase for our members for 2014 whilst dealing with the Holiday Pay issue separately.

As we have previously notified the company that we are in dispute over clerical grades pay, we will be preparing to ballot our Clerical Grades members for industrial action on the issue of pay.

Unless the company indicate that that are willing to reconsider their offer for 2014 then within the next two weeks we will be asking for our members to undertake a ballot as to whether or not to take industrial action. We intend to co-ordinate this with the other trades unions in terms of timescales.
