JARVIS: Tribunal update

Following the Employment Tribunal decision on the 22nd August 2011, we have now received the judgment from the tribunal judge which covers, in the main, all the members made redundant by Jarvis Rail and Fastline on or after the 31st March 2010.

Jarvis: Tribunal Decision for Failure to Consult

Further to our recent announcement on the web site following the Employment Tribunal decision on the 22nd August 2011, we have now received the judgment from the tribunal judge which covers, in the main, all the members made redundant by Jarvis Rail and Fastline on or after the 31st March 2010.

As Jarvis has no money the compensation will have to be paid from the redundancy fund. However, there is a limit of 8 weeks pay which can be paid and this is subject to a cap on a week’s pay (of £380). If you were owed any wages by Jarvis and this was paid by the Redundancy Payments Office then this will reduce the amount you can claim (e.g. if you received 2 weeks outstanding pay then you will only receive 6 weeks from the redundancy fund) – this only applies to wages as notice pay, redundancy pay and holiday pay are treated separately and are not taken into consideration. Tax/NI and Jobseekers allowance may also be deducted.

The next step in the process is for members covered by this decision to contact the Redundancy Payments Office to claim the compensation and to ensure that they have your up to date contact details. This office may send the paperwork automatically but please don’t wait for this to happen. You will have received information from this government department already when you received your redundancy payments and contact details will have been supplied directly to you.

Please ensure you make contact with the Redundancy Payments Office, as soon as possible. Inform them you are claiming the protective award for a failure to consult arising out of the tribunal which sat on the 22nd August 2011. Do not wait for them to contact you.

It is likely to take several weeks for the payments to be processed given the number of employees involved.
