Network Rail: P&T staff on former Jarvis Rail contracts of employment

Following helpful replies to our survey by TSSA members, the union has sought further legal advice concerning the P&T step rise pay issue. Our legal advice is that this issue still has legal merits and so the union's lawyers have formally written to Network Rail identifying possible legal action, seeking a formal reply from them, and suggesting that attempts be made to resolve the issue by proposing further meetings with the union. The Company has now acknowledged receipt of the letter, and once a formal reply is received the union's lawyers will re-assess it and provide further advice.

Pending Network Rail’s reply, the union has paused any possible legal action on behalf of affected members (as this would be expected by any court that subsequently hears the possible legal action) and so please have regard to the relevant time limits that apply. The time limit is 6 years from the date of any breach of contract and please note that pending the reply from Network Rail, the union is not taking any action on behalf of affected members to start legal proceedings at this stage. We will of course keep you advised of any developments.
