Network Rail: Professional & Technical staff on former Jarvis Rail contracts of employment

TSSA has been in a long-running dispute with Network Rail over a number of matters relating to the application of former Jarvis P&T terms and conditions. This culminated in strike action being taken last year. Unfortunately, the action did not result in a successful outcome and a meeting between representatives, Steve Coe (Organising Director) and Jerry Wines (Organiser) took the decision to pursue the possibility of taking legal action against the Company to enforce what we believe to be your contractual rights. This process has taken many months, and consisted of collating evidence, obtaining information from members via a survey, and latterly identifying possible test cases and interviewing potential witnesses.

This process has now concluded and following a detailed review and assessment of these possible claims, our lawyers have advised us that based on the evidence provided and witnesses interviewed, the claims do not have reasonable prospects of success. We are sorry that, based on that assessment, we can’t take this matter any further forward for you. Should you decide to take legal action, contrary to our advice, please pay attention to the 6 year time limits that apply to such claims in the civil courts, as we are unable to take responsibility for these. We appreciate this will be disappointing news, but we can only advise on the law as it is and not how we would like it to be. Thank you for your patience and support in this matter. Although the legal route may now be closed, we will continue to pursue our concerns through the normal industrial relations processes and remain committed to securing a satisfactory outcome.
