South West Trains TUPE transfer of provision of Multi Purpose Vehicles (MPV’s) from South West Trains to Balfour Beatty Rail

TSSA was recently informed by South West Trains of the transfer of MPV’s to Balfour Beatty Rail. Part of the transfer process requires consultation to take place with representatives of the employees – the trade unions.


This meeting took place with representation from South West Trains. A number of assurances were sought from Balfour Beatty Rail regarding the transfer that will take place at 00.01 hours on the 20 August 2017. Set out below are the responses from the employer to various issues raised:

1) Employees will retain their existing terms and conditions.

2) Collective bargaining representation will be retained by the trade unions on behalf of employees.

3) Those currently in the South West Trains Railway Pension Scheme will be offered the opportunity to join the Balfour Beatty Rail defined contribution scheme only and not Balfour Beatty Rail Railway Pension Scheme. The TSSA stated that this will be a great disappointment to those transferring.

4) There are no proposals to change the current structure or numbers of employees.

5) There are no BR protected employees transferring who will be eligible to retain their travel facilities. However Balfour Beatty are in discussion with First (the new franchisee on the Wessex route) to request that duty passes be provided. If not they may need to provide road transport for some of those transferring employees.

6) Balfour Beatty does not provide four weekly pay it can offer those transferring either weekly or monthly pay. The monthly pay is paid on the 15th of the month and is based on two weeks in arrears and two weeks in advance. Balfour Beatty will inform us on how they propose to support employees through this transition.

7) New PPE, mobile phones, lap tops and vehicles will be provided to use as a result of the transfer for those that currently have them.

8) Balfour Beatty Rail could not confirm where the depots will be and where the vehicles will be maintained.

9) Balfour Beatty Rail said they are currently advertising vacancies.

10) Local Agreements will be honoured. Annual leave currently booked will also be honoured for 2017 and Balfour Beatty runs the same leave year as SWT. Flexible working was arrangement to be discussed with individuals at one to one meetings.

11) It was unknown if the transfer has been safety validated.

Representatives from Balfour Beatty Rail will meet transferring employees on a one to one basis, after the date of transfer.
