TUPE Transfer Balfour Beatty Rail to Colas Rail final consultation

There was a final meeting with Balfour Beatty and Colas Rail but there still remained some outstanding issues requiring clarification.

 

TSSA used the opportunity to raise some further questions with the incoming employer – set out below are the responses:

1) The transfer of East Kent Re-signalling will take place at 23.59 on the 21st August 2014.

2) Colas Rail will not ask any Balfour Beatty employee to be seconded to Colas Rail.

3) There remains a major issue in respect of non protected and no indefeasible right (pension) status employees who will not be allowed to join the Colas Rail Section of the Railways Pension Scheme (RPS). TSSA is asking any member affected by this to contact us immediately.

4) Balfour Beatty and Colas Rail are still currently discussing the possible purchase of the S&T vehicles.

5) Colas Rail is still discussing work locations with Network Rail and Balfour Beatty. Although Brentwood Depot will be relocated, agreement has not been reached on the move to Romford.

6) Balfour Beatty advised us that they were still looking at the situation of their bonus scheme and whether individuals would receive 7/12ths of the 2014 bonus.

7) Balfour Beatty said Network Rail had signed off on the filling of some vacancies but not all. Those with outstanding issues should still pursue them. HGP scenarios will continue after the transfer to allow continuity in the new contract

8) The plan was still to sell the Small Plant organisation to Torrent Trackside before the transfer of the RT24 contract.

9) Network Rail is to agree a separate contract with Colas Rail covering the loading team at Hoo Junction until the end of 2014.

10) During the meeting TSSA again expressed concern that Colas were maintaining the position that they believed there were too many track grades transferring to the Plain Line and not enough to the S&C contract and were running the two contracts separately. However, their measures letter to employees said that it had agreed to transfer all employees without differentiating between these two contracts. It is also the case that for the first time Colas mentioned they do not intend using in-house employees for any welding. They would, however, be offering transferring welders the opportunity to apply for welding inspection jobs and would be looking to offer other employment.

11) It was confirmed that of those employed in the ETE Department at Three Bridges three employees had been identified as transferring to Babcock Rail at Eastleigh.
