TUPE Transfer Croydon Tramlink to Tfl

21 January 2011

TSSA recently attended a consultation meeting under the TUPE (Transfer of Undertakings Protection of Employment) regulations on the transfer of employees working on the Croydon Tramlink track contract. The date of the transfer was at midnight on the 8th January 2011.

At the meeting assurances on the following issues were given:

- Employees transferred will retain their terms and conditions on transfer as per the regulations. But the application of those terms & conditions will allow some changes to benefits that members have. Tfl have, however, offered new contacts of employment with an improved salary.
- Tfl will continue to recognise the trade unions for collective bargaining.
- All employees will have continuity of employment.
- Tfl PPE was provided on day one after the transfer, as will mobile phones.
- Those protected employees with staff travel entitlement will retain it.
- Annual leave for 2011 will be honoured.

Some outstanding questions will be considered at a further meeting. These include:
- Pensions for those in the Railway Pension Scheme.

Members will, of course, be provided with further information as soon as possible.
