TUPE Transfer CTRL Plant Employees

TSSA recently attended the reconvened consultation meeting under the TUPE (Transfer of Undertakings Protection of Employment) regulations on the transfer of employees working on the CTRL Plant contract.

This meeting dealt with unresolved issues from the initial meeting and letter of intent received from Balfour Beatty Rail Plant and the following assurances issues were given:

- Employees transferred will be able to join the Balfour Beatty Defined Contribution Pension Scheme where and can contribute at the current levels to the Carillion scheme.
- If an individual receives a car allowance this will continue after the transfer. If an individual has a company car they will be provided with the equivalent by Balfour Beatty Rail Plant on 1st April 2011.
- Travel facilities for the one protected employee will continue.
- Local agreements will be honoured.
- All employees will receive their pay from Carillion up to 1st April on 22nd April and then receive three weeks pay from Balfour Beatty on 29th April. Balfour Beatty. It was recognised that there is a week’s difference in the pay cycle and are, therefore, prepared to make an interest free loan of three weeks wages to be repaid over a six month period.
- No plans to close Singlewell or reduce the establishment.
- Opportunities for Operators work on the classic lines if they wish and Heavy Maintenance will be carried out at Ashford Depot.
- Roster will only be changed through negotiations with the representatives.
- The final list of staff on the TUPE list was produced and accepted by all parties.
