TUPE Transfer CTRL Rail Plant to Balfour Beatty Rail Plant

TSSA recently attended a consultation meeting under the TUPE (Transfer of Undertakings Protection of Employment) regulations on the transfer of employees working on the CTRL Plant contract. The date of the transfer will be the 1st April 2011.

At the meeting assurances on the following issues were given:

- Employees transferred will retain their terms and conditions on transfer as per the regulations.
- Balfour Beatty Rail Plant will continue to recognise the trade unions for collective bargaining.
- All employees will have continuity of employment.
- Local agreements will be honoured if raised by employees before the transfer and as part of the associated consultation process.
- Balfour Beatty PPE will be provided on day one after the transfer as will mobile phones. Hopefully the same mobile phone numbers can be retained.
- The pay anniversary for CTRL staff is in line with the rest of Balfour Beatty Plant – i.e. 1st January.
- Those protected employees with staff travel entitlement will retain it.
- Annual leave for 2011 will be honoured but outstanding 2010 leave should be taken by the 31st March 2011.

Some outstanding questions will be considered at a further meeting. These include:

- Pensions for those in the Railway Pension Scheme and those in the Carillion Pension Plan;
- Balfour Beatty’s acceptance of employees on the TUPE list;
- Company car policy and number of company vans provided.

Member will, of course, be advised of further information as soon as possible after the next meeting.
