What is action short of strike?

What does action short of strike (ASOS) mean? It means members can incorporate action into their daily, working life outside of any strike days we may take. You must have been balloted for this action.

Trade union legislation requires unions to describe the ASOS they intend to take on ballot papers. TSSA will have specified this on members’ ballot papers and we will issue members with guidance about the types of action called when we notify employers of our intention to take industrial action. Unions must give a minimum of two weeks’ notice for industrial action – whether it is strike action or ASOS.

Action short of strike called

TSSA has called industrial action short of a strike in several train operating companies.

The specific types of industrial action short of strike (ASOS) vary slightly across different companies. Please check what action is allowed and advised at your company from the list below.


TransPenine Express (TPE)

The action short of strike will be discontinuous and will take place on the intended dates, set out below and on such further dates as will be notified in due course.

From 00:01 on Tuesday 9th August 2022 to 23:59 on Wednesday 7th September 2022.

Types of industrial action short of a strike:

  • Overtime ban
  • Refusal to work rest days
  • Ban on non-rostered staff working weekends and nights
  • Ban on undertaking contingency duties arising from industrial action
  • No mentoring of colleagues including new starters
  • No training of colleagues including new starters
  • No double desking (no carrying out work of absent colleagues and vacancies)
  • Ban on on-call activities including ban on covering vacant on-call lines
  • Ban on out of hours work communication


Northern Rail

The action short of strike action will be discontinuous and will take place on the intended dates, set out below and on such further dates as will be notified in due course.

From 16:00 on Wednesday 17 August 2022 to 08:00 on Monday 22 August 2022.

The types of industrial action short of a strike are:

  • Overtime ban
  • Call-out ban
  • Ban on undertaking contingency duties arising from industrial action
  • Ban on non-rostered staff working weekends and nights
  • Ban on out of hours work communication

 

West Midlands Trains

The action short of strike action will be discontinuous and will take place on the intended dates, set out below and on such further dates as will be notified in due course.

From 00:01 on 18 August 2022 to 23:59 on 20 August 2022.

The types of industrial action short of a strike are:

  • Ban on unpaid overtime
  • Ban on paid overtime
  • Ban on on-call activities
  • Ban on activities associated with voluntary contingency cover.


Greater Anglia

The action short of strike action will be discontinuous and will take place on the intended dates, set out below and on such further dates as will be notified in due course.

From 00:01 on 18 August to 23:59 on 20 August.

The types of industrial action short of a strike are:

  • Ban on paid and unpaid overtime
  • Ban on on-call activities
  • Refusal to work rest days and un-rostered Sundays
  • Work only to pre-agreed rosters
  • No mentoring or training of colleagues including new starters
  • Refusal to support technological online ticket issues
  • Ban on voluntary contingency cover and all associated activities
  • No covering of duties and tasks of other roles/grades
  • Work to rule, including refusing lone working where it goes against company policies and procedures
  • Ban on cross-cover and working at other locations that are NOT your home station


Southeastern:

The action short of strike will be continuous and will start from 18 August and will continue until further notice.

From 00:01 18 August until further notice.

The types of industrial action short of a strike are:

  • Call-out ban 
  • Ban on undertaking contingency duties arising from industrial action 
  • Ban on non-rostered staff working weekends and nights 
  • Ban on out of hours work communication
